Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DR Bardawam app and website (the "Service"), operated in Iraq. By creating an account or placing an order, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility & Accounts

You must provide accurate, current information (name, phone number, and, optionally, email) to create an account.
You are responsible for verifying your phone number via the OTP code we send you, and for keeping your password confidential.
You are responsible for all activity that occurs under your account.

2. Orders, Pricing & Payment

Placing an order through the Service is an offer to purchase the selected products at the price and quantity shown at checkout.
Product prices, availability, and delivery fees may change at any time before an order is confirmed.
We may cancel or refuse any order, including for suspected fraud, pricing errors, or stock unavailability, and will inform you if this happens.
Accepted payment methods are shown at checkout.

3. Delivery & Setup Service

You choose between standard delivery or delivery with on-site setup ("delivery + setup") where offered for a given product.
Delivery times are estimates and may vary based on your location, order volume, and circumstances beyond our control.
You must provide an accurate delivery address/location and be reasonably available to receive the order; we are not responsible for delays caused by incorrect or incomplete delivery information.
Where on-site setup is included, our personnel will assist with basic installation as described for that product; this is not a substitute for professional medical training or guidance from your healthcare provider.

Before using any medical device or product, read the manufacturer's instructions and consult a qualified healthcare professional to confirm it is appropriate for your condition.

4. Cancellations, Returns & Refunds

You may cancel an order while it is still "pending" or "confirmed" by contacting us; orders already out for delivery may not be cancellable.
For hygiene and safety reasons, certain medical products may not be eligible for return once opened or used, unless defective.
Defective or incorrect items may be returned or exchanged; contact us promptly with your order details.

5. Reviews & User Content

You may submit ratings and reviews for products you have purchased.
Reviews must be honest, your own opinion, and must not contain false, defamatory, abusive, or unlawful content.
We may remove any review that violates these Terms or applicable law.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or to commit fraud;
Attempt to gain unauthorized access to the Service, other accounts, or our systems;
Interfere with or disrupt the Service's operation;
Misrepresent your identity or provide false order/delivery information.

7. Intellectual Property

The Service, including its content, logos, and design, is owned by or licensed to DR Bardawam and is protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute it without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, DR Bardawam is not liable for any indirect, incidental, or consequential damages arising from your use of the Service or use of any product purchased through it. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for defective products as required by Iraqi law.

9. Account Suspension & Termination

We may suspend or terminate your account if you violate these Terms, misuse the Service, or for security reasons. You may stop using the Service and request account deletion at any time as described in our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Iraq, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Iraq.
